Recently, Zhou Wu, a migrant worker in Wanzhou District, Chongqing, received more than 20,000 yuan in arrears of wages from his employer. Previously, Zhou Wu sought help from the local trade union, and under the promotion of the five-party linkage mechanism for the prevention and resolution of labor disputes in Wanzhou District, Zhou Wu reached a mediation agreement with the employer, and the employer agreed to pay the arrears of wages as soon as possible. This is an example of a labor dispute successfully resolved by the Wanzhou District Federation of Trade Unions using the five-party linkage mechanism.
In recent years, Wanzhou District General Administration has further strengthened the management of the source of labor disputes, and taken the lead in jointly establishing a five-party linkage mechanism for the prevention and resolution of labor disputes with the District Justice Bureau, the District Human Resources and Social Security Bureau, the District Court, and the District Procuratorate. According to statistics, since the beginning of this year, nearly 160 disputes have been successfully mediated by the five departments.
According to the framework agreement of the five-party linkage mechanism, the five departments will simultaneously establish a daily contact mechanism and meeting system for the source management of labor disputes, set up a joint mediation matrix, and determine the annual rotation to hold regular communication and exchange meetings to study, guide, coordinate and supervise the source management of labor disputes in the whole region, and strive to solve problems such as the unsmooth connection of labor dispute resolution, mediation and adjudication, and the inconsistent application of law, so as to form a multi-faceted dispute resolution mechanism that is comprehensive and complementary.
Through the five-party linkage mechanism, Wanzhou District has promoted the labor dispute mediation room of the district trade union to settle in the Wanzhou Economic Development Zone, the District Court, the Arbitration Court of the District Human Resources and Social Security Bureau, and the Migrant Workers Pioneer Park. Guide the 18 system trade union working committees at the district level, 52 township and neighborhood trade unions and enterprises to set up mediation organizations, and jointly promote the improvement of the organizational structure of labor dispute mediation at the employer, village (community), township (street), and district levels. At the same time, give full play to the mediation role of online platforms, and promptly report wage arrears that may lead to mass labor disputes.
Xu Mingyun, deputy director of the Standing Committee of the Wanzhou District People's Congress and chairman of the District Federation of Trade Unions, said that the five-party linkage mechanism is an extension of the litigation and mediation docking mechanism established by the District General Administration and the District Court in recent years, which has made up for the shortcomings and deficiencies of the mass labor dispute resolution work, and has played an important role in promoting the pre-litigation resolution of labor disputes.
