Mondo Social Updated on 2024-01-31

The process of applying for evidence notarization is as follows:

1.Prepare the required materials: The applicant should submit the ID card, business license, legal representative certificate and other materials to the notary office, and elaborate on the relevant circumstances of the application for notarization, and provide true, legal and sufficient supporting materials.

2.Determine the evidence to be notarized: The evidence to be notarized must be related to the rights and interests of the applicant and have legal significance, such as evidence that is easy to disappear.

3.Filing an application for notarization: The applicant should apply to the notary before the proceedings take place. According to the applicant's application, the notary office will extract, store, fix and describe the evidence and behavior process related to the applicant's rights and interests and have legal significance, or provide notarization services for the authenticity and probative power of the applicant's evidence collection behavior.

4.Acceptance of application: After accepting the applicant's application, the notary office will conduct verification and evaluation to determine whether notarization preservation is required, and issue a notarial certificate to the applicant within 15 working days.

5.Pay the notary fee: During the application process, the applicant needs to pay the notary fee.

6.Collect the notarization documents: After the notarial certificate is completed, the applicant can collect it according to the requirements of the notary public.

It should be noted that if the application is for extraterritorial evidence, according to the provisions of the newly promulgated New Rules on Evidence, only the relevant certification procedures are required, but for evidence involving identity relationships, the notarization and authentication procedures are still required. Therefore, when applying, it is advisable to consult a professional lawyer to analyze and decide whether notarial preservation is required.
