Recently, Ms. Liu, a citizen of Wuhan, reported to Jiupai News that the house she bought was "dropped". I spent 1.85 million yuan to buy a river-view house, but when I got it, I found that I couldn't see the river at all. The purchase contract shows that Ms. Liu subscribed to a certain house No. 5401, which is not the same as the house she initially fancied.

Ms. Liu said she bought a house three months ago for a total price of 1.85 million. When I closed the house this month, I found that it was not the suite I fell in love with at the beginning. When I bought the house, I bought it because I had a good view of the river, but now the house I have in hand is on the other side, and I can't see the river at all.

The suite purchased by Ms. Liu is located on the K1 plot of Zhongjian Bo Mansion on Baishazhou Avenue in Wuhan City. The sales receipts show that she subscribed to a certain house No. 5401, but according to her recollection, the door was not marked with the room number when she looked at the house, "I have never stepped into the door of 5401." ”

Before purchasing the house, Mr. Zhang, the agent, had accompanied Ms. Liu into the building twice to see the house. Mr. Zhang confirmed that the house he had set at the beginning could indeed see the river.

However, the floor plan of the floor in the purchase contract shows that room No. 1 (5401) is checked, and Ms. Liu's signature and handprint are also in the blank space next to it. Ms. Liu said she didn't look closely at the time.

The chat records show that after the incident, Ms. Liu told the agent Mr. Zhang that the house she bought was different from the one she saw at the scene. The other party agreed, "Yes, the entity I looked at is 5404, I remember." ”

On December 27, Ms. Liu called the intermediary Mr. Zhang**. The other party confirmed to her that the house that was set at the beginning was indeed on the west side with a view of the river, but what was actually purchased was room 5401 where the river could not be seen, and room 5401 was just a glance. ”

The intermediary, Mr. Zhang, said that Ms. Liu could sue and that he was willing to testify.

So, how should intermediaries and developers be held accountable in this "package dropping" incident?

Responsibilities of intermediaries:

Accurate disclosure of information: The agent has the responsibility to provide accurate and detailed housing information to the buyer, including the basic situation of the house, the floor where it is located, the type of house, the area, etc. If the buyer makes a wrong decision because of the inaccurate information provided by the agent, the agent should be held responsible.

Assist with site visits: Agents should assist buyers in conducting site visits, allowing buyers to see the actual situation of the property in person, so as to avoid misunderstandings about the property.

Contract Explanation: The agent should explain the terms of the purchase contract to the buyer in detail to ensure that the buyer fully understands and agrees to the content of the contract.

Dispute resolution: If there is a dispute between the buyer and the developer or other relevant parties, the agent should actively assist the buyer to solve the problem and protect the legitimate rights and interests of the buyer.

Developer's Responsibilities:

Housing condition assurance: The developer should ensure that the actual condition of the property is consistent with the information provided to avoid causing distress to home buyers.

Contract performance: The developer shall deliver the house on time in accordance with the purchase contract, and ensure that the quality and supporting facilities of the house are in accordance with the contract.

Information disclosure: The developer has the obligation to disclose the relevant information of the house to the buyer, including the property rights of the house, whether there is a mortgage, etc., to ensure the buyer's right to know.

Problem solving: If the rights and interests of the home buyer are damaged due to the developer's reasons, the developer should actively communicate with the home buyer, seek a solution, and bear the corresponding liability for compensation.

However, during Ms. Liu's home purchase process, it was clear that the developer and the agent had not fulfilled these obligations.

First of all, the floor plan shown to Ms. Liu by the real estate consultant did not match the actual house she had purchased, but the house number was not marked at the door, which led to Ms. Liu's misunderstanding when choosing a house. Secondly, when Ms. Liu asked to take pictures of the actual appearance of the house that had been set, the real estate consultant did not take the photos on the grounds that the door of the house was locked, so that Ms. Liu could not confirm the specific situation of the house she purchased. In the end, when the decoration designer went to the site to measure the house, the staff still brought room 5404 in Ms. Liu's photo, which further misled Ms. Liu.

It is obvious that the real estate consultant is deliberately burying a hole for Ms. Liu. Since the agent Mr. Zhang also admitted that the house that Ms. Liu looked at when she bought the house was Room 5404 with a view of the river, and was willing to help Ms. Liu testify, it is even more certain that it was a deliberate fraud by the real estate consultant.

Therefore, in this case, Ms. Liu can communicate and negotiate face-to-face with the developer through the intermediary to strive for a reasonable solution. If the negotiation fails, she may consider filing a complaint with the relevant authorities or seeking legal assistance.
