On October 20, 2023, a worker was electrocuted during the operation of a tenant in Xinkengling Industrial Zone, Shenkengling Industrial Zone, Meilong Town, Haifeng County, and died after rescue.
After the accident, in accordance with the relevant provisions of the "Work Safety Law of the People's Republic of China" and the "Regulations on the Reporting, Investigation and Handling of Production Safety Accidents" (Order No. 493), the county established the "Haifeng County Meilong Town '10.20' General Electric Shock Accident Investigation Team" (hereinafter referred to as the "Accident Investigation Team") composed of personnel from the County Emergency Management Bureau, Meilong Town People's **, County Power Supply Bureau, County Public Security Bureau, and County Federation of Trade Unions to carry out accident investigation. In accordance with the principles of "four do not let go" and "scientific and rigorous, in accordance with laws and regulations, seeking truth from facts, and paying attention to practical results", the accident investigation team ascertained the process, causes and personnel of the accident through on-site investigation, investigation and evidence collection and comprehensive analysis, identified the nature and responsibility of the accident, put forward suggestions for dealing with the relevant responsible units (personnel), analyzed the main problems exposed by the accident, and put forward suggestions for accident rectification and preventive measures.
After investigation, it was determined that the "10.20" electric shock accident of SITC Meilong was a general production safety liability accident caused by the lessee Qin *li's failure to perform safety production management duties and inadequate safety protection measures.
First, the basic situation of the accident.
1) Workshop leasing.
On July 2, 2023, the lessee Qin *li and the lessor, Haifeng County NWS Jewelry, reached an oral agreement on the leasing of the jewelry workshop, and the lessor leased its workshop 601 in Building B to Qin *li. Lease area of 124 square meters, lease term: no fixed term, lease fee: 25 yuan square meters, monthly payment, tap water fee: 6 yuan cubic meter, well water fee: 3 yuan cubic meter, electricity and management maintenance fee (including wastewater treatment fee): 11 yuan, waste gas electricity apportionment: 1500 yuan per month, waste gas system management and maintenance: 500 yuan per month, transfer solid waste (gypsum powder) 100 yuan furnace, workshop operating profit and loss. The lessor is responsible for connecting water and electricity to the door of the 601 workshop in Building B, and the lessee is responsible for the water and electricity in the workshop, all equipment and facilities and safety work, and the safety work outside the workshop is responsible for the lessor, and the waste water and waste gas generated by the workshop are harmlessly treated by the lessor. The lessee must be inspected by the lessor.
2) Basic information of the lessee.
Qin *Li, male, from Guigang, Guangxi, is the lessee and main person in charge of the 601 workshop of Building B of Xinjian Jewelry in Haifeng County.
3) Profile of the lessor.
Haifeng County NWS Jewelry*** hereinafter referred to as "NWS Holdings") was registered in Haifeng County Market Supervision and Administration Bureau on May 22, 2017, unified social credit **: 91441521MA4WKN89X9, enterprise type: limited liability company (natural person investment or holding), establishment date: 2017-05-22, legal representative: Yu Bingyi;Registered address: Shenkengling Industrial Zone, Meilong Town, Haifeng County, registered capital: 2 million yuan, business scope: jewelry manufacturing, processing and sales;Domestic**;Property Leasing;Realty management. NWS Holdings' main business is the leasing of workshops (factories), which are used for jewelry processing. At present, the business situation is normal.
4) How the accident occurred.
After on-site monitoring** and investigation and questioning of relevant personnel, it was determined that the accident occurred as follows
On the evening of October 20, 2023, Yang *cai, Qin *li, and Yang *cai were engaged in jewelry processing and mold related work in the 601 workshop of Building B, Xinjian Jewelry, Haifeng County. Qin * Li and Yang * Cai are in the heating area of the workshop, putting the semi-finished copper ornaments on the ground into the oven to bake, so that they can be used the next day;Yang* was working alone in the flushing area in slippers. At about 20 o'clock, Yang * picked up the metal handle of the pressurized water gun from the ground with his bare hands, and was stuck by the pressurized water gun and could not break free, and then lost his balance and fell on the cement floor of the workshop together with the pressurized water gun. After Qin * Li and Yang * Cai heard the "bang", they quickly walked into the flushing area from the heating area, and saw Yang * Cai lying face down on the ground, Qin * Li wanted to help Yang * Cai up, and his hands felt electric shock when he touched Yang * Cai, and then immediately stepped to the right wall to turn off the power of the booster water machine, and trotted to the door of the workshop to turn off the total power supply of the workshop. Then Qin *li and Yang *cai turned Yang *cai's body over, and carried out first aid measures such as compression and cardiopulmonary resuscitation, and dialed 120 first aid**, because Yang *cai could not wake up after first aid, Yang *cai carried Yang *cai downstairs to wait for the 120 ambulance. Soon after, after the 120 ambulance arrived, Yang * was sent to the Meilong Town People's Hospital for rescue. At 22:10 that night, Yang* died after the doctor's all-out rescue efforts failed. At 19:07 on the 21st, Yang *cai dialed 110 to call the police**, saying that his brother Yang *cai was accidentally electrocuted while working in the workshop.
5) The situation at the scene of the accident.
The accident site covers an area of about 124 square meters, with jewelry processing equipment and facilities, and the left side of the workshop is the heating area (see Figure 1), the oven is set up, and the right side is the flushing area (see Figure 2). In the flushing area, the ground is successively arranged (put) from the entrance to the inside: mixer, power socket, small industrial fan, retracter, metal mesh tube pressurized water gun (see Figure 3), the bottom of the mold, the inner side is set up on the right side of the booster water machine (see Figure 4), water storage barrel, air switches are arranged on the walls on both sides, and 1 high-power exhaust fan is arranged on the inner wall. The metal mesh tube pressurized water gun is connected to the pressurized water machine.
6) The safety management of the unit where the accident occurred and related units.
1.The unit where the accident occurred.
Qin *li, the lessee and main person in charge of the workshop, did not implement the main responsibility of safety production, did not carry out risk identification and hidden danger investigation and management, did not equip labor protection equipment and urged it to wear and use, safety production protection measures were not in place, and did not formulate the corresponding safety production management mechanism.
2.Lessor: Haifeng County New Creation Jewelry***
The company has formulated safety production rules and regulations and operating procedures, prepared emergency rescue plans, established the safety production responsibility system of the unit, signed a safety production responsibility letter with the company's employees and all tenants, and agreed on their respective safety production management responsibilitiesRegularly carry out safety production education and training in the unit, and conduct safety production inspections on the workshop every month.
7) Personnel and direct economic losses.
1.One person died as a result of the accident.
Yang *cai, male, from Guiping, Guangxi, a worker in the tenant's workshop, was electrocuted in the accident and died after being sent to the hospital for rescue.
2.Direct economic loss.
The aftermath of the accident is being dealt with, and it is not possible to estimate the direct economic losses at this time.
2. Emergency response and assessment of accidents.
1) Accident information receipt and response.
At 19:00 on October 21, 2023, Yang *cai called 110 to report to the police** that his brother was electrocuted to death in workshop 601, Building B, Xinjian Jewelry, Haifeng County. After receiving the report, the 110 command center immediately assigned the Meilong Police Station to the scene of the accident to investigate and investigate the relevant personnel involved. After investigation, the Meilong Town Police Station reported the relevant situation to the 110 Command Center of the County Public Security Bureau and the people of Meilong Town, and the 110 Command Center of the County Public Security Bureau notified the County Emergency Management Bureau. After receiving the report, the county emergency management bureau immediately sent personnel to the scene of the accident to investigate, and at the same time reported the accident information to the people of Haifeng County and the Shanwei City Emergency Management Bureau.
2) Emergency response and medical treatment at the scene of the accident.
After the accident, the on-site personnel Qin * Li and Yang * Cai took emergency rescue measures and called 120 emergency in time. After receiving the report, the 120 emergency center quickly dispatched personnel to the scene and sent Yang * to the People's Hospital of Meilong Town, Haifeng County for rescue. At 10:10 p.m. on October 20, 2023, Yang* died after rescue efforts failed.
3) Accident emergency response assessment.
After the accident, the on-site personnel responded quickly and took corresponding emergency measures in time. The 120 ambulance arrived at the scene in time and immediately sent Yang * to the hospital for rescue. After receiving the report, the relevant departments sent personnel to the scene of the accident to carry out the accident investigation. The accident information reporting channels are unimpeded, the information flow is timely, the emergency response is rapid, the on-site disposal measures are appropriate, the aftermath work is carried out in an orderly manner, there are no derivative accidents in the emergency disposal of the accident, and no dereliction of duty or dereliction of duty of the rescue command staff is found. After evaluation, the emergency response to the accident was appropriate, the emergency measures were in place, and the emergency response was timely and efficient.
3. Analysis of the cause of the accident.
a) Direct causes.
After the accident investigation team called the on-site monitoring, the county power supply department was organized to investigate, analyze and review the scene, and determined that the direct cause of the accident was
1.The booster (water pump) installed in the flushing area of the workshop has a voltage after the booster is started in a humid environment. The metal handle of the pressurized water gun is connected to the booster water machine through the metal mesh tube, resulting in the presence of voltage in the metal handle as well. When the human body is not properly protected against electric shock, it comes into contact with a metal handle with voltage, resulting in electric shock to the human body.
2.Employee Yang *cai, with weak safety awareness, did not carry out safety inspections for this position, failed to discover and take corresponding measures for potential safety hazards in the equipment in time, did not wear and use personal protective equipment correctly (wearing slippers on his feet), and directly touched the metal handle with voltage with his hands, resulting in electric shock.
2) Indirect causes.
The lessee Qin *li failed to implement the main responsibility of the main person in charge of production safety, failed to perform the duties of safety production, and failed to urge employees to wear labor protection equipmentFailure to carry out risk identification and hidden danger investigation and management, and failure to timely discover and take measures to eliminate the leakage risk of booster water machine;Failure to provide safety education and training to employees.
3) Exclusion of other possible factors.
According to the on-site monitoring, investigation and comprehensive analysis, as well as the supporting materials issued by relevant departments, the cause of the accident ruled out homicide.
Fourth, the main problems existing in the unit (personnel) where the accident occurred.
The lessee and the main person in charge, Qin *li, failed to implement the main responsibility for production safety. Failure to establish, improve and implement the safety production responsibility system for all employees in the workshop;Failure to organize the formulation and implementation of the safety production rules and regulations and operating procedures of the workshop;Failure to organize the formulation and implementation of the workshop safety production education and training plan;Failure to organize the establishment and implementation of a dual prevention mechanism of hierarchical control of safety risks and hidden danger investigation and management, supervise and inspect the safety production work of the workshop, and eliminate hidden dangers of production safety accidents in a timely mannerFailure to supervise and educate employees to wear labor protection equipment in accordance with the rules of use.
5. Suggestions for dealing with the relevant personnel of the accident.
1) Employee Yang *cai, weak safety awareness, insufficient understanding of the risk factors existing in the operating environment, did not wear labor protection equipment during the operation, due to the leakage of the booster water machine, the current was conducted to the metal handle of the booster water gun, resulting in an electric shock accident, and was responsible for the occurrence of the accident. Due to the death in the accident, it is recommended that he not be held responsible for the accident.
2) The lessee Qin * Li, as the main person in charge of the workshop, failed to perform the safety production management duties stipulated in the "Work Safety Law of the People's Republic of China" and was responsible for the occurrence of the accident. It is recommended that the Haifeng County Emergency Management Bureau impose an administrative penalty on Qin * Li in accordance with the provisions of Article 95, Paragraph 1 of the "Work Safety Law of the People's Republic of China".
6. Accident rectification and preventive measures.
In order to learn the lessons of SITC Meilong's "10.20" general electric shock accident and prevent similar accidents, the following accident prevention measures are proposed:
1) Lessee Qin * Li.
In accordance with the "Work Safety Law of the People's Republic of China" and other relevant laws and regulations, it is necessary to perform the duties of safety production management, carry out the risk identification and hidden danger investigation and management work in the rental car rental room, especially to strengthen the investigation and management of hidden dangers in electrical facilities and equipment and fire safety work, and prevent the recurrence of similar accidents.
2) Haifeng County New Jewelry***
It is necessary to strengthen the unified coordination and management of the lessee's safety production work, conduct regular safety inspections, and promptly supervise and rectify safety problems if they are found to prevent the recurrence of similar accidents.
3) The people of Meilong Town**.
In accordance with the principle of "territorial management", it is necessary to strengthen the supervision and inspection of the safety of electrical equipment and facilities of production and business operation units, especially enterprises below designated size. In view of the problems exposed by this accident, we should strengthen the publicity and education on the safety of electrical equipment and facilities of production and business operation units in the jurisdiction, enhance the safety risk awareness of employees, earnestly do a good job in safety production, and effectively prevent and resolutely curb the occurrence of production safety accidents.
