"Gathering Litigation and Disputes: The Discourse of the Qing Dynasty's "Healthy Litigation" and Its Expressive Reality

In many different types of documents, such as local chronicles, official letters, and official documents of the Qing Dynasty, it is common to see records claiming that there was a "healthy style of litigation" in a certain area. The above phenomenon is in contrast to the argument that "no litigation" is the value orientation and typical feature of traditional Chinese legal culture, which has been emphasized by the academic circles in the past.

This book analyzes the writing of the "style of litigation" in historical documents from the different perspectives of textual dimension, discourse practice dimension and social practice dimension, and regards it as a kind of discourse full of power relations, arguing that this kind of discourse presents more of an expressive reality, and cannot be directly regarded as a completely truthful reflection of the historical and social status quo at that time. Some of the intended functions of the discourse, what other discourses are used by these subjects to cooperate, and what practical actions are taken that seem to be targeted.

This book strives to follow the academic interest of the research paradigm pioneered by Qu Tongzu, and practices the historical approach of law and social research in terms of methodology, and does not simply return to the historical scene of ancient China to restore the historical facts about the "style of healthy litigation" as the ultimate goal, but focuses on analyzing some important theoretical issues hidden behind the historical records of the "style of healthy litigation" with theoretical concern in the sense of social science, hoping to advance our understanding of traditional Chinese law and law from the historical dimension. In-depth understanding of society and the state.
