In Dazhou, Sichuan province in southwestern China, a villager's actions provoked a legal outcry over protecting a neighbor's crop. The villager was severely punished by law for setting up a deadly power grid to prevent wild boars from encroaching on farmland, despite the ban on hunting.
The Sichuan Dazhou Bureau of Justice showed the profound lessons of this case to the public through its WeChat***. The reason was that the two villagers took measures to lay power grids for hunting in order to cope with the severe problem of farmland frequently damaged by wild boars, but this behavior violated the bottom line of the law.
In June 2022, villager Xiao faced the situation that his farmland was destroyed by wild boars, and it was urgent to solve it. He found his neighbor Gui, who was good at grid hunting, and asked for help. Gui was invited to accompany because of his sympathy for the harvest, but he ignored that the entire territory of Xuanhan County, the county where he was located, was a hunting ban area, and the violation was about to cause accidents.
After investigation by relevant departments, it was found that this hunting method seriously damaged local wildlife resources, and according to the Criminal Law of the People's Republic of China and the Wildlife Protection of the People's Republic of China, the behavior of the two villagers constituted the crime of illegal hunting. After hearing the case, the court ruled on a specific sentence, and Gui was sentenced to five months of detention with a ten-month suspended sentence.
This case illustrates how to correctly face the conflict between wildlife and agricultural production in daily life, and how the public lacks awareness of current laws and regulations. Although the villagers in this case are motivated by the protection of agricultural products, they ignore the legitimate rights and interests of wild animals and ecological protection regulations. The occurrence of this case is a reminder of the need to raise legal awareness and avoid falling into the situation of breaking the law due to blindness or ignorance. There is no contradiction between protecting the ecology and acting in accordance with the law, and a reasonable approach can take into account the safety of farmland and the protection of wild animals.
