The People's Court of Jiande City, Zhejiang Province heard a private lending dispute case: the plaintiff Xu held an IOU and demanded repayment from the borrower Xiao Shao and the guarantor Lao Shao (Xiao Shao's father). **, the defendant was not present, and the court ruled in absentia that he should repay the loan, and then Xu applied for compulsory enforcement.
It wasn't until the property was seized by the court that Lao Shao knew that he had become a guarantor, so he filed a protest with the procuratorate, and finally was able to unseal the property with the help of the procuratorate.
Previously, Xiao Shao borrowed money from Xu, and Xu agreed to lend it, but asked Lao Shao to guarantee it. A few days later, Xiao Shao gave Xu an IOU with Lao Shao's signature and fingerprint.
Later, the procurator obtained Lao Shao's signatures when he received grain and agricultural subsidies, applied for a marriage certificate, and handled banking business, and compared them with the signatures on the IOU, and found that Lao Shao's handwriting did not match the two places. In order to ensure that nothing goes wrong, the prosecutor also conducted a fingerprint identification, but Lao Shao has been working hard for many years and his fingerprints are blurred, so the procuratorate adjusted his thinking and directly compared Xiao Shao's fingerprints and found that they were completely consistent with those on the IOU. Therefore, it was determined that the signature and fingerprints on the IOU were counterfeited by Xiao Shao.
In the end, the court revoked the original judgment and ordered the defendant Xiao Shao to repay the loan, and at the same time held Xiao Shao responsible for forging his signature.
In this case, Xiao Shao was able to deceive Xu by taking advantage of the two major drawbacks of paper IOUs: one is that it cannot be signed in real time in other places, and the other is that signatures and fingerprints are easy to forge and not easy to detect.
