Xue Jianguang pointed out that the "Coal Mine Safety Supervision Regulations" promulgated in 2000 and the "Special Provisions on the Prevention of Coal Mine Production Safety Accidents" promulgated in 2005 were based on the level of economic development 20 years ago. In the current situation of high coal production, there may be a lot of coal mining enterprises "would rather pay fines than illegal production".
A few days ago, the "Regulations on Coal Mine Safety Production" (hereinafter referred to as the "Regulations") was publicly released. Xue Jianguang said that the "Regulations" have made the following provisions in terms of further increasing the cost of illegal enterprises: first, increase the lower limit of the amount of fines; the second is to introduce new heavier penalties; the third is to strictly suspend production and rectify the requirements; Fourth, increase the intensity of closure.
On the basis of maintaining the convergence with the Work Safety Law and other laws, the Regulations have raised the lower limit of penalties for illegal acts of coal mining enterprises and enterprise leaders. For example, according to the Work Safety Law, the lower limits of fines for enterprises with general, large and major accidents are 300,000 yuan, 1 million yuan and 2 million yuan respectively. The Regulations were raised to $500,000, $1.5 million and $5 million respectively.
In terms of strict requirements for suspension of production and rectification, the "Regulations" stipulate that if there are major hidden dangers and still production, production shall be suspended for rectification; Where there are safety violations that have not been corrected within the time limit, production shall be suspended for rectification; If there are safety violations, or major hidden dangers cannot be guaranteed before or during the elimination process, the operators shall be withdrawn and production shall be temporarily stopped. At the same time, it is required that coal mines that have been suspended for rectification shall formulate a rectification plan, and the regulatory authorities shall announce the list of coal mines that have been suspended for rectification to the public within 5 working days, and organize the resumption of production and acceptance in accordance with regulations.
In addition, the "Regulations" will include coal mines that do not have the conditions for safe production without obtaining a safety production license, those that have been found to have major accidents twice or more within three months, and that the existing technical conditions are difficult to effectively prevent and control major disasters.
