The basic principles of daily wage calculation
According to the Labor Law of the People's Republic of China and related regulations, the calculation of daily wages is mainly based on two factors: the monthly wage standard of the worker and the statutory number of paid days per month.
Monthly salaryThis is the basis for calculating the daily wage, which usually refers to the normal wage income of the employee in a month, including basic salary, allowance, bonus, etc., but excluding non-recurring income such as overtime pay, year-end bonus, etc.
Statutory number of pay daysAccording to national regulations, the number of paid days per month is not simply 30 or 31 days, but takes into account factors such as statutory holidays and rest days. The average number of days worked in a month (i.e. statutory paid days) in a standard month is about 2175 days (calculated based on (365 days - 52 weeks 2 days) 12 months, of which 52 weeks and 2 days are rest days in a year).
The specific calculation method of daily wage
The formula for calculating the daily wage is:Daily wage = monthly wage standard Statutory pay days
For example, suppose that the monthly wage standard of a worker is 8,000 yuan, and the number of days of salary calculated according to the law is 2175 days, then his daily wage should be: 8000 yuan 2175 days 367$82. This means that if the worker had been working normally on a given day, he would have received about 367$82.
Issues to be aware of:
Overtime pay is calculated: When calculating overtime pay, it is usually calculated on the basis of daily wages. For example, overtime work is usually paid at 150% of the daily wage, and overtime work on rest days without compensatory time off is paid at 200% of the daily wage.
Monthly wage changesIf there is a change in the monthly wage of the worker, the daily wage shall be adjusted accordingly.
Statutory holiday payStatutory holidays are usually paid at the rate of normal wages, even if the worker does not actually work that day.
Contracts & RegulationsThe specific wage calculation method may also be affected by the employment contract, company rules and regulations, or collective contract, so it should be considered comprehensively in practice.
Labor Law of the People's Republic of ChinaThe law stipulates the basic rights and obligations between workers and employers, including the payment of wages, working hours, rest and vacation, etc.
