Length of service and working hours are often confused, but they have different meanings.
Length of service is the actual number of years of service of a staff member after he or she has entered the workforce. Participation in working hours is the starting point for staff members to participate in work on a full-time basis. Participation in working hours is the starting point of seniority, and seniority is the total number of hours in which they have been working.
Illustrate. After graduating from university in July 2005, a cadre signed a contract with a company and began to work. After that, the cadre moved to another company in October 2005 to continue working, but due to the short time, the original unit did not have time to purchase pension insurance for him. In the new unit, the cadre worked until March 2008, and the company continued to purchase pension insurance for him until he was admitted to the state civil service. According to the regulations on the calculation of continuous length of service, the first unit failed to purchase pension insurance for the cadre in time, so it was unable to calculate his working hours as length of service. In the second unit, the cadre worked until March 2008, and the company has been purchasing pension insurance for him, so it can be counted as continuous service. In other words, Xiao Wang's first time in work was in July 2005, and the starting time of his length of service was October 2005.
Definition of working hours for participation.
1) Before the implementation of the Labor Contract Law on January 1, 2008, the date of signing the labor contract for the first time or the date on which the enterprise went through the employment procedures shall be used as the basis for determination.
2) If a worker is hired after the implementation of the Labor Contract Law on January 1, 2008, the date of employment shall be used as the basis for determination.
3) If a worker participates in the examination of an ordinary college or university and is re-dispatched after graduation, his or her working hours shall be determined, and the regular workers shall be subject to the recruitment time, and the contract workers or long-term temporary workers shall be calculated according to the date of reporting to the unit after graduation and assignment.
How is length of service calculated?
The current calculation of length of service in China mainly includes continuous calculation, combined calculation, and recalculation.
Continuous calculation: refers to the method of continuous calculation when calculating the working years (length of service) of an employee whose working hours have not been interrupted, but who have worked in several different units.
Combined calculation: refers to the method that the working time before and after an employee participates in the work due to objective reasons or non-personal subjective will, resulting in intermittent length of service, after deducting the period of time that cannot be calculated as continuous length of service, the working time before and after the employee can be combined to calculate the continuous length of service.
Recalculation: For a small number of personnel who have interrupted their work for special reasons and then joined the work, their previous working hours are not calculated, and the continuous length of service is calculated from the date of re-joining the work.
