Judicial Recommendations Promote Win Win Financing of the Company in Arrears of Wages was successful

As the New Year approaches, workers are eager to get back their arrears of wages, and they are particularly eager to go home for the New Year with peace of mind. In order to allow workers to celebrate the New Year with a safe "salary", the People's Court of Dongcheng District, Beijing Municipality implemented a bright sword in the cold winter, made every effort to protect the people's hearts, took multiple measures to promote the implementation of people's livelihood cases, and successfully implemented them before the Spring Festival.89With a case payment of 80,000 yuan, he successfully helped 17 workers get labor remuneration. On the morning of January 31, some labor representatives and the company subject to enforcement sent pennants to Li Chunshuang, the executive judge of the Dongcheng District Court for cases involving people's livelihood, to express their gratitude.

Since April 2023, employees of a technology company in Beijing have successively applied to the Dongcheng Court for compulsory enforcement, demanding that the company pay labor compensation. At first, there were funds available in the company's account for enforcement, and the court deducted the case money and issued it to the employee in a timely manner. However, since June, the company's account has not been credited, and Li Chunshuang led the team members to the company subject to execution to conduct an on-site investigation. After on-the-spot investigation, it was found that in addition to the computers, desks and chairs used at work, the company has no other assets with property value, and it is a typical asset-light company based on science and technology. If the equipment is directly seized and the materials are counted for execution, in view of the actual situation of this case, the company's assets obviously cannot cover the execution payment, and the enforcement effect is not ideal.

In the communication with the person subject to execution, Li Chunshuang learned that the company is in a critical period of financing, and if it can operate normally, ensure that the products are delivered on time, and the follow-up financing is successful, the company's employees will have great hope to get their wages back. If it is implemented directly, the company is operating abnormally, and the employees have little hope of getting their wages back.

During the enforcement process, Li Chunshuang found that the company had not declared its assets to the court, and the communication with the court and employees was very lax, resulting in employees not understanding the actual situation of the company, becoming emotional, and having a strong desire to ask the court to enforce it. Li Chun issued a "Judicial Suggestion Letter" to him, urging the company to actively declare its assets to the court, promptly report the amount of wages paid to employees privately and the company's true financial situation, and suggested that the company do a good job in reassuring and reconciling employees. The company believed that the problems found by the court were directly to the crux of the matter, and the company promptly declared its property status to the court, and also actively communicated with the employees, informed them of the actual business conditions, sought the understanding of the employees, and negotiated the wage payment plan with the employees.

Adhering to the concept of goodwill and civilized implementation, Li Chunshuang coordinated many times, organized employees to negotiate with the company, and finally facilitated the employees and the company to reach a settlement agreement, winning time and opportunities for the company's financing, and the case ushered in a turnaround.

At the beginning of January 2024, the company successfully obtained financing and remitted the case money to the court account as soon as possible. With the joint efforts of the court and both parties, the case finally ushered in a win-win outcome. On January 31, after completing the payment confirmation procedures, the employees who were in arrears received their due wages one after another.

Every salary is related to the happiness of the individual worker and his family. Only by making workers pay their wages can we feel at ease. Zhao Qing, deputy director of the Dongcheng Court Executive Bureau, said that in the future, the Dongcheng Court Executive Bureau will continue to adhere to the people-centered, grasp the enforcement cases with the concept of "as I am suing", handle every enforcement case involving people's livelihood with heart and emotion, fairly and efficiently honor the rights and interests of the parties to win the lawsuit, and respond to the new expectations and new requirements of the people for justice in the new era with practical actions.
