Recently, in the process of handling a dispute over a sales contract, the judge of the Pu'er Court of the Yanjin County People's Court handled another case that might enter the litigation together, and completed the performance on the spot, which won the praise and praise of the parties.
Xiao and Ren had a cement sales contract relationship from the end of 2016 to 2018, Xiao supplied and sold cement to Ren, and Ren paid Xiao for cement from time to time. At the end of 2023, Xiao believed that Ren still needed to pay more than 150,000 yuan for his cement, so he sued the court. After this court accepted the case, considering that the plaintiff did not appear in person, and its client failed to state in detail the facts that need to be ascertained in this case, it required both parties to be present in person to be questioned and check the accounts in detail.
On March 5, 2024, the plaintiff and the defendant came to the court together to conduct a detailed check and found that according to the unit price of cement floating in the market and the actual number of tons of transportation that could be determined, Ren not only paid off the cement payment, but also overpaid. Based on this, the plaintiff was willing to withdraw the lawsuit, but the defendant Ren demanded that Xiao return the expenses he had overpaid, otherwise he would have to sue in a separate case.
In order to effectively resolve the contradiction between the two parties and stop another dispute before the lawsuit, the undertaking judge once again conducted in-depth communication with the two parties, so that the parties understood that the dispute arose from the fact that the two parties did not reconcile and settle the accounts in time after the end of the cement supply, and also let them understand that the subsequent litigation costs could be reduced by resolving the dispute at one time.
