On December 30, 2019, the trio was put on trial for their unauthorized climbing. Among them, two men were sentenced to prison, and the woman was exempted from criminal responsibility, and at the same time, the three of them had to pay 6 million in joint and several compensation.
Is it possible that climbing a mountain is also a crime?
All three were brought together by the interest of "climbing", and they had not met until March 2017.
The person who came up with the idea, Zhang Yongming, thinks that indoor climbing and outdoor climbing are not challenging or exciting at all.
When he said this idea, Mao Weiming and Zhang Lu echoed it, and like-minded people immediately formed a climbing trio and searched for exciting mountains all over the country.
They searched and searched, and finally found the Giant Python Peak in Sanqing Mountain, Jiangxi. After the three agreed, Zhang Yongming began to prepare various climbing tools, considering that there might be more sentry boxes near Monty Python Peak, so they decided to climb at night and wait for the sunrise to enjoy the beautiful scenery.
At the beginning of April, they came to the scene to step on the spot, and as soon as they entered the scenic spot, they ignored all kinds of warning signs and blindly rushed to their dreams.
After stepping on the spot, they laid out a careful plan, with the experienced Zhang Yongming taking the lead, and the other two following behind.
In the early morning of the 5th, the climbing trio came to the foot of Monty Python Peak, and excitedly and cautiously, set off towards the "road of crime".
Strictly speaking, the three of them did not climb with their bare hands, and even embarrassed the climbing world, they first used drones to put ropes around the protruding rocks in the rock mass to play a protective role.

Tourists looked up and found that someone was climbing Monty Python Peak, and they exclaimed, which also attracted the management of the scenic spot.
They gathered at the foot of the mountain, ** this performance to run to prison, and at the same time worried about their personal safety, some people shouted uneasily: "Come down, it's too dangerous!" ”
But Zhang Yongming and the three of them didn't care about the shouts below, and climbed towards the top of the mountain intently.

In the end, Mao Weiming returned the same way, and Zhang Yongming took Zhang Lu to the top.

Through drone surveys, 26 pitons were found in the Giant Python Peak mountain, all of which were in dangerous terrain and difficult to climb. Geologists have determined that their actions have caused irreparable damage to Monty Python Peak.
Among them, when nailing pitons, they also used expansion screws to increase friction, and expansion screws will speed up the erosion process of Monty Python Peak.
More critically, there are 4 expansion screws nailed into the vital joints, which is likely to cause the Monty Python Peak to collapse, and once a passenger passes by, there will be incalculable consequences.
When these evidences are placed in front of Zhang Yongming and others, they can't understand why they have to go to jail if they climb? Zhang Yongming also responded stiffly: "Is it difficult to climb Mount Everest, is it also a crime?" ”
This shows that Zhang Yongming's relevant knowledge reserve is insufficient, he thinks that he can cope with things by writing a guarantee, but as an amateur climber for more than ten years, he ignores a principle: not to destroy nature.
Back then, Alain Robert gave up on the summit for the following reasons:I hate destroying nature's fines, so I'd rather not climb to the top of Monty Python than climb with the help of equipment.
Zhang Yongming and the three of them were to satisfy their personal desires, so they caused irreversible repairs to the Giant Python Peak, and they couldn't even pull out the pitons, otherwise they would cause secondary damage to the Giant Python Peak.
On August 15, 2018, the Shangrao Municipal Procuratorate filed a civil environmental public interest lawsuit against the three men, believing that they were not only suspected of intentionally damaging places of interest.
The front is a criminal case, ** broke the truth with Zhang Yongming, and he accepted it, but he couldn't accept the civil lawsuit in the back.
He defended: "I have stainless steel screws, and your home, for example, stainless steel, pots and pans, are all stainless steel, and you say that I am polluted?" ”
This sentence once again reflects that poor Zhang Yongming's knowledge reserve is very insufficient, and environmental protection here refers to environmental protection.
Three months later, in this case**, Zhang Yongmingfang's defense lawyer, took out a piece of granite at the scene, and after driving a piton of the same specification, claimed: no cracks or changes were detected in the rock.
In fact, anyone who has ever worked in construction knows that when you put a nail on a stone, it feels like there is no change, but where you can't see it with the naked eye, the stone is changing at an accelerated pace, and if it is a mountain, once it reaches the limit, it will collapse with a bang.
Although the defense lawyer said that it was okay to drive the pitons, experts at the scene did not agree with him.
You must know that Monty Python Peak is a precious natural heritage formed after 300 million years of wind and rain wipers, and it has very important research value, which is not equivalent to ordinary granite.
The geologists forcefully refuted the opposing lawyer's arguments.
The verdict was made in the first instance: Zhang Yongming and Mao Weiming committed the crime of intentionally destroying places of interest and historic sites, Zhang was imprisoned for one year, and Mao was sentenced to six months with a one-year probation.
At the same time, there is a civil lawsuit, and the three of them need to apologize to the public, and they also have to pay 6 million.
The three of them were not satisfied with this result and appealed, and the original verdict was upheld in the second instance.
The three of them, after all, still have to pay for their ignorance and selfishness.
The arrest, sentence, and punishment of Zhang Yongming and the others caused a great deal of discussion at the time of the incident, with some people believing that the crime was not so much, others feeling that they deserved it, and some people thinking that they had lost the face of the climbing world.
However, from a legal point of view, rock climbers are keen on wild rock climbing, and the first principle is not to destroy nature, let alone destroy natural heritage, otherwise the economic, ecological and cultural value will be almost impossible to estimate.
Take the Giant Python Peak incident as an example, the economic value loss caused by the three of them is at least about 11.9 million.
