Article 2 These measures apply to all employees of the company.
Chapter II: Principles of Punishment.
Article 3 The principle that the economic losses caused to the enterprise must be compensated. Any economic loss caused to the enterprise shall be compensated for the loss and eliminate the impact, such as the loss of raw materials, plant fire or product damage due to personal reasons.
Article 4: The principle of joint and several liability for economic penalties shall be implemented. and where there is direct leadership responsibility for economic losses, joint and several liability is to be borne.
Chapter III: Scope of Punishment.
Article 5 Any personal reason that causes the following economic losses to the company shall be compensated for the losses.
1.Failure to take active measures against accidents, disasters and hidden dangers that affect production has delayed the handling time and caused economic losses to expand.
2.Violating the company's regulations, causing losses in contracts, guarantees, or breach of contract, or lax execution of contracts, resulting in economic losses.
3.Taking advantage of the convenience of the post or business to hand over the business to one's relatives, friends, acquaintances or interested units to operate or cause economic losses.
4.Purchasing goods from relatives, friends, acquaintances, and related units (heightened, quality does not meet requirements, enterprises are not in urgent need, overstocked, etc.) are used higher than the market to cause economic lossesCausing economic losses to relatives, friends, acquaintances, and interested units of the company's products, equipment, and belongings below the market.
5.Using the company's name and intangible assets to engage in business activities or transfer them to others for business operations and causing losses.
6.The work is irresponsible, resulting in waste and rework losses;Lost items;Causing loss of work;Purchasing inferior equipment, accessories, equipment and raw materials, causing losses to the company.
7.misappropriation, concealment, or private use of company property, funds, and equipment, causing losses.
8.Financial personnel violate the provisions on fund receipt, payment, reimbursement, asset management, etc., causing losses to the enterprise.
9.The company's employees are not serious and responsible for their own work or are negligent, resulting in losses for the company.
Chapter IV: Compensation Standards.
Article 6 The behavior that is not enough to pursue criminal responsibility, but causes losses to the company, shall be punished in accordance with these measures and the "Public Security Punishment Law".
Article 7 For those who are both responsible and victims in the accident, the company shall bear part of the expenses in accordance with the relevant regulations, and other expenses shall be borne by the individual.
Article 8: Where economic losses are caused by personal reasons, the economic penalties shall be implemented in two grades: direct economic losses of less than 10,000 yuan (inclusive) shall be punished at 30% of the amount of losses;If it is more than 10,000 yuan, it will be punished by 20%. At the same time, the responsible person who causes economic losses of more than 100,000 yuan (inclusive) to the enterprise will directly terminate the labor contract and will not make economic compensation.
Article 9 For economic losses caused by multiple departments and multiple people, the total proportion borne by each department shall be implemented according to two grades: direct economic losses of less than 100,000 yuan (inclusive) shall be punished by 40%;If it is more than 100,000 yuan, it will be punished by 50%. The division of responsibilities between departments is approved by the organization meeting according to the size of the responsibility, and the fines are apportioned to the individuals.
Chapter V: Specific Provisions.
Article 10 After the occurrence of economic losses, the department shall report in a timely manner, and the relevant departments of the company (responsible department or administrative personnel department) shall collect evidence in a timely manner and immediately organize the reduction of losses.
Article 11 In the event of economic losses, the Ministry of Finance and the Ministry of Administration and Personnel shall exercise qualitative, quantitative and pricing functions in coordination with the relevant departments.
Article 12 The penalty amount shall be deducted from the monthly salary, and the bonus part shall be deducted first, and shall not be deducted from the basic salary if it is not enough, and the specific implementation shall be carried out according to the amount of the penalty and in accordance with the relevant regulations of the Labor Law.
