How can assets be unfrozen if they are frozen?

As long as the reason for the freeze disappears (resolved), the party concerned may apply to the court to lift the freeze. The court will verify the situation and, if it is true, will unfreeze the account.

There is also a time limit for freezing an account. After a certain period of time, you can apply to lift the freeze.

Legal basis

According to the Provisions of the Supreme People's Court on the Sealing, Seizure and Freezing of Property in Civil Enforcement by Courts, the period for which a people's court freezes the bank deposits and other funds of a person subject to enforcement shall not exceed six months, the period for sealing or seizing movable property shall not exceed one year, and the period for sealing immovable property and freezing other property rights shall not exceed two years. Except as otherwise provided by laws and judicial interpretations.

Apply for property preservation

If you are worried that the effective judgment will not be enforced in the future or want to avoid property loss, you can apply for property preservation. Submit the application and provide relevant evidence to the people's court.

After the court accepts the application for property preservation, it shall make a ruling within five days. If the situation is urgent, a ruling must be made within 48 hours.

Property freeze

For real estate, it is generally not directly frozen, but measures such as seizure and auction are taken. There are also provisions on the time limits for sealing, seizing and freezing assets.

Urging the court to enforce it

If the court's judgment has taken effect, but the frozen account has not been unsealed, you can urge the court to enforce the judgment as soon as possible.
