Fresh lights usually refer to lighting and other facilities that beautify the appearance of fresh foods such as meat, vegetables, melons and fruits by adding the color of a specific light source. In recent years, the use of fresh lamps to "beautify" edible agricultural products on sale has gradually become a common marketing method in agricultural markets, supermarkets, fresh stores and other places. Although the use of fresh lamps will not affect the quality and safety of food by dissipating heat, it can cover up defects, beautify the appearance and color of food, and affect consumers' ability to distinguish when purchasing with a "false and good-looking" appearance, which infringes on the rights and interests of consumers to a certain extent, and is not conducive to fair competition in the market, affects the healthy development of the consumer market, and arouses public concern. In order to respond to the public's concerns about "fresh lights" in a timely manner and promote the standardized and orderly development of the fresh product consumption market, the State Administration for Market Regulation issued the Measures for the Supervision and Administration of the Quality and Safety of Edible Agricultural Products in the Market (hereinafter referred to as the "Measures") on June 30, 2023, which clearly stipulates that "the sale of fresh edible agricultural products shall not use lighting and other facilities that cause obvious changes to the true color and luster of edible agricultural products to mislead consumers about the sensory perception of the goods". After the implementation of the Measures on December 1, 2023, if a seller of edible agricultural products still uses lighting and other facilities that do not meet the requirements, the market supervision and administration department at or above the county level will order corrections and give a warning; and where corrections are refused, a fine of between 5,000 and 30,000 RMB is to be given. In the work of ensuring the implementation of the above provisions, market supervision departments at all levels have taken the initiative to increase publicity and guidance before and after the implementation of the "Measures", actively carried out supervision and inspection and special governance, put an end to "beautification" misleading consumption, restored the original appearance of fresh products, and achieved good social results. Advance publicity, supervise self-examination and self-correction
After the promulgation of the Measures, combined with different online and offline channels, widely carried out publicity and popularization of law. The first is to achieve offline publicity to be specific to people. Carry out training and visits to the persons in charge of market operators and sellers of edible agricultural products, distribute the "Measures", leaflets, picture albums and other legal popularization materials, and publicize the new regulations and new requirements. In the past five months, according to incomplete statistics, the market supervision department has distributed and posted nearly one million copies of relevant publicity materials in farmers' markets, supermarkets and other places, effectively improving the awareness of the "Measures" on the prohibition of fresh lights. The second is to achieve a wide reach of online publicity. Case 1Chengdu Municipal Market Supervision Bureau, Sichuan Province, the new ** Internet celebrity column "You click me to check, Brother Du is here" released on the official Douyin account of the short ** "The "beauty camera" in the fresh food industry will be banned from December 1!! The number has reached more than 310 million times, and the number of likes is about 1280,000, directly promoting more than 4,000 fresh edible agricultural product sellers in Chengdu to take the initiative to replace the "fresh lamp" in advance. Case 2The Heilongjiang Provincial Market Supervision Bureau made a unified template for the whole province and issued the "Reminder and Warning on the Use of "Fresh Lamps" in the Sale of Edible Agricultural Products for the Operators and Sellers of Edible Agricultural Products Market. In conjunction with Heilongjiang Provincial TV Station "Food Safety Longjiang", Heilongjiang Metropolis Channel "News Night Flight" and other columns, it has strengthened the publicity and implementation of the new regulations through on-site inspections twice, and urged the main body of edible agricultural products to standardize the configuration of lighting fixtures. The "Architectural Lighting Design Standard" (GB 50034-2013) stipulates the lighting standard value of various public buildings such as shops, supermarkets, farmers' markets (specific indicators include illuminance standard value, unified glare value, general lighting illuminance uniformity and color rendering index), which can be used as a reference basis for setting up lighting fixtures in supermarkets, supermarkets, centralized trading markets, fresh stores and other edible agricultural product business places. Many localities have also taken various forms to further refine the regulatory requirements for lighting and other facilities in edible agricultural product business premises in combination with local conditions.
Case 3The Hubei Provincial Administration for Market Regulation has established a "quadripartite coordination" mechanism between grassroots supervision offices, market operators, sellers of edible agricultural products and consumers, so that stakeholders can communicate and negotiate in a friendly manner, and unify the understanding of the use of lighting fixtures in the vegetable market to "return the natural color of meat, vegetables, melons and fruits". At the same time, it clarifies the standard of "one reference, three shall not", that is, "refer to the selection of lighting fixtures close to the primary color of daylight, shall not use colored light sources, shall not be covered with colored lampshades, and shall not mislead consumers", which provides an operational basis for the prohibition of "fresh lamps" and the replacement of lamps and lanterns that are not only in line with traditional cognition but also supported by technical standards. Case 4Zhejiang Provincial Market Supervision Bureau docked with professional and technical institutions to carry out comparative experiments on the technical indicators of lamps and lanterns, carried out empirical activities of meat stall lamps and lanterns in farmers' markets, and included "reasonable technical values for the lighting of meat trading areas in farmers' markets" in the revised "Identification Standards for Assured Farmers' Markets", and replaced 28,023 standardized lighting fixtures in the 370 new farmers' markets in the province. Strengthen supervision and carry out special governance
After the implementation of the Measures on December 1, 2023, market supervision departments across the country will focus on the sales of edible agricultural products such as agricultural wholesale (farmer's) markets, shopping malls, supermarkets, and fresh fruit and vegetable stores, and conduct a comprehensive investigation of the use of "fresh lights" that may affect consumers' sensory judgments, and put forward on-site rectification requirements for merchants who use lamps and lanterns that do not meet the requirements, and supervise their implementation. According to incomplete statistics, in the first month of the implementation of the "fresh lamp ban", the local market supervision departments have inspected more than 300,000 sellers of edible agricultural products, ordered rectification of 28,526 edible agricultural product business entities that are still using "fresh lamps", and issued 62 fines for refusing to make corrections. The masses generally reported that the red, green, and green "fresh lights" in the original market were gone, and they could finally see the true face of meat, vegetables, melons and fruits. Case 5Zhejiang Province has formulated an action plan for the standardized management of food safety in fresh stores, incorporated lighting requirements into the "Food Safety Management Specifications for Fresh Stores", and urged fresh business households to standardize the use of lighting fixtures. As of the end of December 2023, the province has inspected more than 13,000 business entities of various types and replaced 19,897 fresh lamps. At present, the city's 240 farmers' markets have completed the rectification of the lighting fixtures in the meat trading area, and 1,036 fresh stores and large and medium-sized supermarkets have taken the lead in rectifying in place, and a total of 4,718 fresh lamps have been replaced. Case 6Jiangsu Province has comprehensively carried out the investigation and management of the prohibition of "fresh lights" through "linkage of inspection and supervision, synchronization of unannounced visits and inspections". The market supervision department shall conduct centralized inspections on the use of lighting facilities for operators of fresh edible agricultural products in various places, strictly prohibit the use of lighting facilities that obviously change the true color of edible agricultural products, and organize personnel to carry out unannounced spot checks. As of the end of December 2023, the province has inspected a total of 7,953 business entities of various types and urged 2,755 to carry out rectification. In the next step, the State Administration for Market Regulation will continue to firmly establish the people-centered development thinking, effectively solve the problems of the masses, continue to increase market supervision and inspection, prevent the resurgence of "fresh lights", effectively safeguard the legitimate rights and interests of consumers, and ensure that the people can buy and eat with peace of mind.
