Notice on the legal liability for illegal parking and charging of electric bicycles
In order to prevent fires caused by electric bicycles, protect the safety of people's lives and property, and maintain public safety, in accordance with the "Fire Protection Law of the People's Republic of China" and "Regulations on Fire Safety Management of High-rise Civil Buildings" and other regulations, the legal responsibility for illegal parking and charging of electric bicycles is hereby notified as follows:
1. It is strictly forbidden to park or charge electric bicycles in the public foyer, evacuation walkway, corridor, stairwell, safety exit, fire lane, and fire truck climbing operation site in the building; Electric vehicles, bicycles and batteries are not allowed to go upstairs to enter the house, and wires and sockets are not allowed to charge electric bicycles in violation of electricity safety requirements.
2. If there is any of the above-mentioned behaviors in high-rise civil buildings and refusal to make corrections, a fine of not less than 2,000 yuan but not more than 10,000 yuan will be imposed on business units and individuals, and a fine of not less than 500 yuan but not more than 1,000 yuan will be imposed on non-business units and individuals;
3. If there are any of the above-mentioned acts in other civil buildings, a fine of not less than 5,000 yuan but not more than 50,000 yuan will be imposed on the unit, and a warning or a fine of not more than 500 yuan will be imposed on the individual;
4. Where a fire is caused by illegal parking or charging, and it does not constitute a crime, the responsible person shall be detained for between 10 and 15 days, and may be fined up to 500 yuan; where the circumstances are minor, a warning or a fine of up to 500 yuan is to be given;
5. If a fire is caused by illegal parking or charging, and a crime is constituted, criminal responsibility will be investigated according to the crime of "fire" or "fire accident accident", and the responsible person shall be sentenced to fixed-term imprisonment of not less than 3 years but not more than 7 years; where the circumstances are more minor, a sentence of up to 3 years imprisonment or short-term detention is to be given.
The general public should effectively enhance the awareness of fire safety and consciously standardize the parking and charging behavior of electric bicycles. Owners' committees, owners' meetings and property service companies should increase the management of electric bicycle parking and charging, and stop violations.
