Contact**: In accordance with the provisions of the Civil Code of the People's Republic of China and relevant laws and regulations, Party A and Party B and Party C have reached this agreement on the employment of domestic nannies on the basis of equality, voluntariness and consensus

1. Service matters

1. Service content: Party A agrees to appoint a housekeeper for Party B's family to undertake Party B's ( ) service

1) General housework;(2) Maternal care;(3) Infant care;(4) Elderly care;(5) Semi-independent patient care;(6) Unable to take care of patients on their own;(7) Hospital care for patients;(8) Miscellaneous.

Party C shall meet the working standards according to the requirements of Party A and Party B.

2. Service period: from YYYY-XX-XX to YYYYY-MM-DD. If Party B needs to renew the Agreement, Party B shall notify Party A and Party C within a few days before the expiration of this Agreement.

5. Service fee: Party B shall pay Party A's service fee (including the salary of Party C of the housekeeper and Party A's management fee) on a monthly basis: RMB per month, and Party B shall pay the service fee to Party A before the day of each month.

6. Injury insurance and other insurance benefits: Party A shall pay work-related injury insurance for Party C, and Party A shall organize Party C to participate in commercial accident insurance for those engaged in infant care and infant care.

2. Party A's rights and obligations

1. Party A shall appoint domestic servants who have passed the physical examination and have the corresponding service ability for Party B, and the domestic attendants must have "ID card", "health certificate" and "training certificate" before they can engage in housekeeping services.

2. Party A shall pay work-related injury insurance premiums for its domestic servants in accordance with the law, and the expenses shall be borne by Party A. Party A shall organize Party A to participate in commercial accident insurance for service personnel engaged in childcare and infant care, and the cost shall be borne by Party C. If Party C causes personal and property losses to Party B due to Party C's liability, the insurance company shall compensate Party B according to regulations.

3. If Party B has any of the following circumstances, Party A has the right to terminate the contract and investigate Party B's corresponding responsibilities:

1) Misleading Party C to leave Party A's management;

2) There is an infectious disease in the family and it is concealed and not reported;

3) Failure to pay the service fee on time;

4) Failing to notify Party A in a timely manner after the change of residential address or service address, or taking Party C away from the agreed service place without permission;

5) Party C's work requirements or content violate national laws and regulations or public security regulations

6) Making things difficult, abusing or beating or scolding domestic helpers

7) Instructing the domestic helper to engage in dangerous work or illegal work, as well as accidental injury to Party C due to Party B's improper arrangement.

3. If Party C is assigned by Party A to commit any illegal act against Party B, Party A shall provide necessary assistance to Party B and relevant departments in handling relevant matters.

3. Party B's rights and obligations

1. Party B shall present a valid identity document when signing the agreement, truthfully stating the specific requirements for the domestic helper, as well as the basic family information related to the health and safety of the domestic helper (such as whether there are infectious disease patients in the family, etc.). Once the agreement is signed, Party B shall be responsible for the management and guidance of Party C.

2. Party B has the right to reasonably select, replace and dismiss the housekeeper. During the agreement period, if there is any change in the service items or service categories of the housekeeper, Party A shall be notified in time so that both parties can change the content of the agreement and the service fee. Party B has the right to terminate the agreement under any of the following circumstances:

1) There are good reasons to justify that the demand for the service no longer exists;

2) Valid evidence proves that Party C has committed illegal acts;

3) After proposing to replace the domestic helper, Party A cannot select a new housekeeping attendant to work after an interval of 7 working days;

4) Party C is still unable to complete the work required by the contract after the adaptation period of the working day, and Party A has successively replaced three people, none of whom can meet the corresponding service standards.

3. Party B has the right to request Party C to re-conduct the physical examination, and Party B shall bear the costIf the physical examination fails, Party C shall bear the responsibility.

4. Party B shall treat people equally, respect the personality and labor of the service personnel assigned by Party A, prohibit abuse and discrimination, and have the responsibility and obligation to protect Party C's personal safety and property safety during the service period. Party B and Party C have the right to refuse the domestic helper to engage in activities unrelated to domestic service in their residence, and the specific requirements shall be agreed between Party B and Party C.

5. Party B has the right to pursue Party C's economic and legal responsibilities for losses caused by its responsibilities in a lawful manner, but shall not take illegal methods such as body searches, seizure of money, ID cards and other valid documents, as well as beatings and coercion.

6. Party B shall specify the requirements and guidance of Party C in terms of housekeeping services for the first time, and Party B shall properly keep the cash and valuables at home to avoid disputes.

7. Party B shall provide Party C with basically the same meals as its general family members, provide them with appropriate and safe places to live, and shall not arrange for Party C to live in the same room with adults of the opposite sex.

8. Party B shall arrange Party C's rest and statutory holidays in accordance with national regulations. If Party C cannot be guaranteed to rest, it shall be given overtime allowance on rest days and holidays according to regulations. Party B shall ensure that Party C has no less than eight hours of sleep every day.

9. Without the consent of Party C and Party A, Party B shall not convert Party C to a third-party serviceIt shall not be taken to other provinces or cities or other non-agreed service places to provide services without authorization;Party C shall not be misled to do anything that violates the law or Party A's regulations on the management of housekeeping services.

10. Party B shall be responsible for the safety of Party C during the service period and the service place, and shall not instruct Party C to engage in dangerous workIn the event of any accidental injury caused by Party B due to Party B's facilities or equipment, Party B shall bear the relevant responsibilities and shall immediately notify Party A. In case of sudden illness or other injuries of Party C, Party B shall take necessary treatment measures.

IV. Rights and Obligations of Party C

1. Enjoy the right to rest, vacation and labor safety and health protection, and Party B has the right to refuse to perform labor safety and health conditions with poor or forced risky operations.

2. If Party B fails to pay remuneration in accordance with the regulations, it has the right to terminate the service agreement in advance.

3. If Party B fails to perform the service agreement or infringes upon the legitimate rights and interests of Party C, Party B has the right to appeal to the relevant departments and has the right to receive compensation.

4. Party C must provide ID card, health certificate and vocational skills training certificate before engaging in housekeeping services.

5. Abide by Party A's rules and regulations and obey Party B's management.

6. Conscientiously complete Party B's work arrangements and achieve the indicators specified in the service agreement.

5. Liability for breach of contract

1. Party A, Party B and Party C shall abide by the contract, and any party violates the contract. The other two parties have the right to terminate the contract and claim compensation for the losses caused by the breach of contract, unless otherwise agreed in the contract.

SixMiscellaneous

This Agreement may be renewed upon expiration. If the agreement is renewed, Party B shall negotiate with Party A and Party C 7 days in advance, and the agreement can only be renewed with the consent of Party A.

2. During the agreement period, if the agreement is terminated normally by the three parties in accordance with the agreement or through negotiation not due to breach of contract, Party A shall refund the remaining service fee to Party B.

3. In the event of any dispute arising from the performance of this contract, the parties shall settle it through negotiationIf negotiation or mediation fails, either party may file a lawsuit with the people's court with jurisdiction where Party B is located.

4. This Agreement shall be executed in triplicate, with Party A, Party B and Party C each holding one copy, and shall take effect from the date of signature or seal.
