In order to thoroughly implement the spirit of the important instructions of the general secretary on the "most rigorous standards" of food safety, implement the "Food Safety Law of the People's Republic of China", "Standardization Law of the People's Republic of China", "Opinions of the Communist Party of China on Deepening Reform and Strengthening Food Safety Work" and optimize the relevant requirements of the business environment, and better meet the needs of the high-quality development of the food industry. Make the following requests:
1. Improve the system and mechanism, and optimize the filing mode and work process
(1) Clarify the nature of the standard filing of food enterprises. The filing of food enterprise standards is the process of archiving and filing food enterprise standards whose food safety indicators are stricter than national or local food safety standards. The standard filing of food enterprises is not an administrative license. The provincial health administrative department should improve the management of food enterprise standard filing, optimize and improve the management system and working procedures, cancel the publicity link before the filing of food enterprise standards, simplify the application materials, cancel the requirements for review before and during the filing, and cancel the practice of stamping the official seal, watermark and record number for the record.
(2) Implement the self-declaration and disclosure system of food enterprise standards. In accordance with the requirements of the "Opinions of the Communist Party of China on Deepening Reform and Strengthening Food Safety Work", "Establishing a Public Commitment System for Enterprise Standards" and "Notice on Printing and Distributing the Reform Plan for Deepening Standardization Work", local health administrative departments should do a good job in the connection between the food enterprise standard filing system and the enterprise standard self-declaration disclosure and supervision system, and guide food enterprises to self-declare and disclose the implemented standards. The first is to encourage food production enterprises to directly log in to the "enterprise standard information public service platform" (for the self-declaration and disclosure of food enterprise standards. Enterprises take the initiative to disclose the food standards they implement on the platform, upload and disclose the food enterprise standards they implement, and complete their self-disclosure commitments. Second, the food enterprise standard text filed by the provincial health administrative departments shall be disclosed in the "Enterprise Standard Information Public Service Platform" in accordance with the unified format, and uploaded by the local health administrative departments in a unified manner. The standard text submitted by the enterprise for filing is made public on the platform, and the filing is completed.
(3) Improve the level of informatization and service efficiency for filing. First, on the basis of the existing informatization work, all localities will realize the "online office" of the whole process of filing by the end of June 2024, and cancel the "offline running" requirement for submitting paper materials. Second, the provincial health administrative departments will complete the data docking between the provincial food enterprise standard filing information system and the "enterprise standard information public service platform" by the end of December 2024, gradually realize direct information reporting, set up a special query module, and complete the unified disclosure and unified query of the national food enterprise standard filing information.
2. Strengthen post-event guidance and strengthen the role of enterprises in abiding by safety and promoting development
1) Strengthen post-filing management. To implement the requirements of optimizing the business environment, the provincial health department should gradually transform the filing of food enterprise standards into post-event management, focusing on the implementation of the main responsibility of food enterprises, and enterprises should be responsible for the legality of submitting filing standards and whether food safety indicators are stricter than food safety standards. For market supervision, social supervision, etc., if it is found that the food enterprise standards for the record violate laws, regulations, national or local food safety standards, and the provisions of relevant departments, the food enterprise shall make corrections. The filing standards that are abolished by enterprises after correction shall be clearly indicated on the "Enterprise Standards Information Public Service Platform".
2) Improve the level of standard formulation and application of food enterprises. The provincial health administrative department organizes technical institutions to strengthen the guidance on the implementation of national food safety standards and local food safety standards for food enterprises, and encourages enterprises to strengthen their own food safety risk management capabilities by strengthening the hygiene requirements of the production and operation process. Encourage enterprises to formulate food enterprise standards to ensure product safety and improve product quality according to the actual needs of production, improve the practicability of standards, and give full play to the positive role of food enterprise standards in promoting industry innovation and promoting high-quality development. Encourage enterprises to participate in the evaluation and comparison of enterprise standards carried out by standardization management institutions and the "enterprise standard leader" system, etc., to promote the quality and efficiency of food enterprise standards.
The provincial health administrative departments should strengthen the organization and leadership, do a good job in organizing and implementing, and our committee will organize the National Food Assessment Center to carry out relevant work guidance and evaluation. The Notice of the General Office of the National Health and Family Planning Commission on Further Strengthening the Management of Food Safety Standards (Guo Wei Ban Food Letter 2016 No. 733) shall be repealed at the same time.
